1. About these terms

These terms govern your purchase of Break Check Roadside Assistance (the “Cover”) from Break Check Auto Care & Inspections ABN 86 693 712 524 (“Break Check”, “we”, “us”). By signing up you agree to be bound by these terms and, by extension, by the underlying terms of cover set by 24/7 Roadservices Australia (see clause 3).

2. Who Break Check is

Break Check is a licensed NSW motor vehicle repairer (MVRL64052) and Authorised Inspection Scheme station (AIS S11534) operating from 66 Camden Valley Way, Elderslie NSW 2570. In relation to roadside assistance, Break Check acts as an authorised reseller and agent for 24/7 Roadservices Australia.

3. Who provides the roadside services

All roadside assistance services are provided by 24/7 Roadservices Australia. This includes dispatch, breakdown attendance, towing, and any benefit payments (such as accommodation, hire car, ambulance, and similar). Break Check does not provide the roadside services directly.

Important: by signing up to Break Check Roadside Assistance, you also agree to 24/7 Roadservices Australia’s terms of cover. Those terms govern what is and isn’t covered, service call limits, benefit caps, and how to make a claim. Their full terms of cover are available on their website at www.247roadservices.com.au. If you cannot locate the current version, contact us and we’ll provide it on request.

4. Commencement period

There is a mandatory 48-hour waiting period between when you sign up and when your cover begins. During this waiting period the cover is not active. If you break down within the first 48 hours, 24/7 Roadservices may still be able to help you on a one-off basis, at their discretion and at their standard call-out rates.

5. Eligible vehicles

Break Check Roadside Assistance is available for standard passenger cars up to 3.5 tonnes Gross Vehicle Mass (GVM) and 5.5 metres in length. Caravans, motorbikes, motorhomes, mobility scooters, and heavy vehicles are not eligible under this cover. Cover applies to the specific vehicles you have listed on your account, not to you as a driver.

6. Payment and renewal

Annual per-vehicle billing. Each vehicle on your account is billed annually on the anniversary of the day it was added to your account.

Automatic renewal. By providing a payment method at signup, you authorise Break Check to charge your card automatically on each anniversary for continued cover. We will send you reminder emails 30, 14, 7, and 1 day before each renewal.

Adding a vehicle. When you add a vehicle to your account after initial signup, you will be charged the full annual price for that vehicle. That vehicle will then renew on the anniversary of the day it was added.

Prices. Prices are as set out at the point of signup and are subject to change at renewal. You will be notified in advance of any price change.

7. Cancellation and refunds

You can cancel your cover at any time from your online account. Cancellation takes effect immediately for future renewals.

No pro-rata refunds. Once cover is active for a given annual period, no refunds are available for the unused portion. Your cover remains active until the end of the paid annual period.

Refunds for failed activation. If 24/7 Roadservices Australia declines to activate your cover for any reason (for example, an ineligible vehicle), you will receive a full refund of the amount paid.

8. Volunteer and community discount programs

Break Check offers wholesale-rate cover to volunteers of approved partner charities and community organisations. Volunteers are enrolled by their charity administrator and can activate cover using the email address they were enrolled under. The volunteer rate applies for as long as the volunteer is active with the enrolling charity.

The $55 annual workshop service credit for volunteers is redeemable only for services performed at Break Check, 66 Camden Valley Way Elderslie NSW 2570. It cannot be redeemed for cash and is not transferable. One credit per volunteer per year.

9. Data and privacy

To provide the Cover we share the following information with 24/7 Roadservices Australia: your name, address, contact phone number, email, and vehicle details. This is necessary so their dispatchers can attend your breakdown. We do not share your payment card details with 24/7 Roadservices Australia. Card details are handled by our payment processor, Stripe.

We handle all personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

10. Limitation of liability

Break Check’s role is limited to selling the Cover and passing on your signup and account information to 24/7 Roadservices Australia. Break Check is not liable for the roadside services themselves, for the response time of any contractor dispatched, for damage caused during a tow or other service call, or for any decision by 24/7 Roadservices Australia to decline a claim under their terms of cover. Any such matters are between you and 24/7 Roadservices Australia under their terms of cover.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.

11. Changes to these terms

We may update these terms from time to time. The current version is always available on this page. If we make a material change, we will notify you by email at least 30 days before the change takes effect.

12. Governing law

These terms are governed by the laws of New South Wales, Australia. Any disputes will be dealt with in the courts of New South Wales.
